These Terms of Service (“Terms”) govern your access to and use of Cast Away, a web application accessible at cast-away-app.com (the “Service”). The Service is operated by High Moon LLC, a limited liability company organized under the laws of the State of Illinois (“High Moon,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent’s or guardian’s permission to use the Service.
2. Accounts
You create an account through our authentication provider, Supabase. The default sign-in method is a passwordless magic link sent to your email. You may also opt into a password from Settings to sign in directly. You are responsible for:
- Maintaining the confidentiality of your login credentials, including any password you set
- All activity that occurs under your account
- Providing accurate information when you sign up
- Keeping the email address on your account current — losing access to it may prevent us from helping you recover the account
We may suspend or terminate accounts that violate these Terms.
3. User Content
Cast Away lets you create Slates (cast lists for a film), cast Bravo / Boo votes on slates and individual picks, follow other users (“Crew”), build a watchlist, and exchange direct messages. Content you create is your “User Content.”
You retain ownership of your User Content. By submitting it, you grant High Moon a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it for the purpose of operating and promoting the Service.
You represent that:
- You own or have the right to submit your User Content
- Your User Content does not violate any law or third-party rights
- Your User Content does not contain spam, harassment, hate speech, sexually explicit material, or content that infringes intellectual property
We reserve the right, but not the obligation, to remove User Content that violates these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Harass, threaten, or impersonate other users
- Attempt to gain unauthorized access to the Service or other users’ accounts
- Scrape, mirror, or duplicate the Service without our written permission
- Use automated means to interact with the Service (other than standard search engine indexing)
- Interfere with or disrupt the Service
5. Third-Party Data and Services
Cast Away displays film and television metadata provided by The Movie Database (TMDB). This data is subject to TMDB’s terms. Cast Away is not endorsed by or affiliated with TMDB.
The Service relies on third-party infrastructure including Supabase (authentication and database), Vercel (hosting), and Stripe (payments, for Auteur). Your use of the Service is also subject to their policies.
6. Subscriptions, Reels, and Payments
Cast Away offers two tiers: Cinephile (free forever) and Auteur, billed through Stripe. Auteur is offered at $4.99 per month or $49.90 per year (about 17% off the monthly rate).
For a limited time at launch, a limited number of subscribers may claim a founding-member rate of $2.49 per month or $24.95 per year, which we will not raise on those accounts as long as the subscription remains active. The founding rate is locked to the account that claims it; lapsed founding subscriptions can be resumed at the same rate, but re-allocating a founding spot to a different account is at our discretion. Founding capacity is shown in real time on the pricing page.
- Subscriptions renew automatically until cancelled
- You can cancel at any time from the Stripe customer portal linked from your account settings; cancellation takes effect at the end of the current billing period
- On cancellation, your account reverts to the Cinephile tier at the end of the period; published User Content remains intact subject to the tier’s caps
We may change standard subscription pricing with at least 30 days’ notice to existing subscribers. The founding rate, once locked to an account, is excluded from price increases for as long as that subscription remains continuously active.
Reels (in-app currency)
Reelsare Cast Away’s in-app currency used to unlock optional cosmetic and supporter features. Reels can be earned through normal participation (voting, commenting, referring friends) or purchasedin one-time top-up packs starting at $1.99. Earned and purchased Reels share a single wallet balance.
- Purchased Reels are credited to your account immediately on successful payment
- Reels have no cash value and cannot be redeemed, exchanged, or transferred between accounts
- A monthly per-account spending cap applies to discourage abuse; the cap is shown on the Reels purchase screen
- Unused Reels remain in your wallet indefinitely while your account is in good standing; account deletion forfeits the balance
Refunds
Subscriptions: Auteur subscription fees are non-refundable. You may cancel at any time; access continues through the end of the current billing period and your account reverts to Cinephile when that period ends.
Reels packs: Purchased Reels are a digital product delivered immediately on payment and are non-refundable once any portion of the balance has been spent. Unspent Reels from a recent purchase may be refunded on a case-by-case basis within 14 days of the transaction — contact support@cast-away-app.com with your account email and the Stripe receipt to request one.
Consumers in the EU, UK, and other jurisdictions with statutory withdrawal rights: By completing a purchase of an Auteur subscription or a Reels pack, you expressly request immediate delivery of the digital content and acknowledge that your statutory right of withdrawal terminates once delivery begins and any portion of the digital content is consumed (e.g. once a single Reel from a purchased pack is spent, or the subscription period begins). You retain the right to withdraw from a Reels pack purchase, prorated for any Reels already spent, within the statutory withdrawal period.
Required-by-law refunds and chargebacks: Nothing in this section limits any non-waivable refund right you may have under applicable consumer-protection law. If you believe a charge is incorrect or fraudulent, contact us before initiating a chargeback so we can resolve it directly.
7. Affiliate Links
Cast Away participates in the JustWatch affiliate program. Some links to streaming services may earn us a commission at no additional cost to you. Our recommendations are not influenced by these affiliate relationships. See our Affiliate Disclosure for details.
8. Intellectual Property
The Service — including its design, code, logos, and brand assets — is owned by High Moon LLC and protected by copyright and trademark law. You may not copy, modify, or create derivative works without our permission.
9. Termination
You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, with or without notice.
Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination will survive.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HIGH MOON LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.
12. Indemnification
You agree to indemnify and hold High Moon LLC harmless from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Illinois, and you consent to their jurisdiction.
14. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms at cast-away-app.com/legal/terms and update the Effective Date. Continued use of the Service after changes constitutes acceptance.
