Cast Away (operated by High Moon LLC) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (the “DMCA”). This page describes how to send us a takedown notice if you believe material on the Service infringes your copyright, and how a user can file a counter-notice if their content was removed in error.
1. Designated Copyright Agent
Notices and counter-notices under the DMCA must be sent to our designated agent at:
DMCA Agent — High Moon LLC
Email: legal@cast-away-app.com
Mail: High Moon LLC, 3231 S Halsted St Suite 224, Chicago, IL 60608
Our agent is registered with the U.S. Copyright Office under registration DMCA-1072670. Email is the fastest channel; the mailing address is provided for filers who require physical service of process. Notices that don’t meet the requirements below may not be actionable.
2. Filing a Takedown Notice
If you are the copyright owner (or are authorized to act on their behalf) and believe content on Cast Away infringes your copyright, send a written notice to the agent above that includes all of the following, as required by 17 U.S.C. § 512(c)(3):
- Your physical or electronic signature (typing your full legal name is acceptable for an emailed notice).
- Identification of the copyrighted work you claim has been infringed (or, for multiple works, a representative list).
- Identification of the material on the Service you want removed, with enough detail for us to find it. A direct link to the slate, profile, or other surface is best.
- Your full name, mailing address, telephone number, and email address so we can contact you.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.
Knowingly making a material misrepresentation in a takedown notice can subject you to liability under 17 U.S.C. § 512(f).
3. What Happens After We Receive a Valid Notice
We will promptly review the notice and, where we determine the notice is valid, remove or disable access to the identified material and notify the user who posted it. We forward the substance of valid notices (including the complainant’s identifying information) to the affected user so they can consider whether to file a counter-notice.
4. Filing a Counter-Notice
If you believe content of yours was removed or disabled in error or as a result of misidentification, you may send our agent a counter-notice including all of the following, as required by 17 U.S.C. § 512(g)(3):
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location at which it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your full name, mailing address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, for any judicial district in which High Moon LLC may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of that person.
On receipt of a valid counter-notice we will forward it to the original complainant. Unless the complainant notifies us within 10 business days that they have filed a court action seeking to restrain you from continuing the activity, we may restore the removed material in 10–14 business days.
5. Repeat Infringer Policy
We will, in appropriate circumstances and in our sole discretion, terminate the accounts of users who are repeat infringers. Receiving multiple validated DMCA notices targeting your content is one such circumstance.
6. Other Copyright Concerns
Not every dispute is a DMCA matter — for example, fan-cast slates may use TMDB-sourced movie metadata under fair use, or actor names may appear in user-created content as ordinary speech. If you have a question about your work or your name on the Service that isn’t a takedown request, email legal@cast-away-app.com and we will respond.
